PHOTOGRAPHY AGREEMENT

This document is a contractual agreement made between: Forbidden Fruit Photography (referred to hereafter as “Photographer”), Model, and Commercial Client (referred to hereafter as “Client”)

AGREEMENT TERMS

PORTRAIT SESSION: Model is guaranteed at least 20 minutes of shoot time per session. Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes. 

CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the amounts paid are non-refundable. Twenty-four hours notice of postponements or cancellations is appreciated.

WEATHER: If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.

 

MODEL WARDROBE: Client can bring their own clothing or choose from a freshly laundered selection provided by Photographer. Photographer may have props/clothing necessary for Client’s preferred outlook.

MODEL’S USAGE: Client is obtaining digital files and a print release. Prints for publication via the model (such as editorial, public relations or advertising use) require prior written consent from Photographer.

 

CLIENT COMMERCIAL USAGE: Client is allowing Photographer to use, publish, print, and distribute photographs for advertising purposes though standard and/or digital media with no additional compensation. Photographer will clear any photos used for commercial purposes with Client The photographs may be used to represent an imaginary, person, and any wording associated will not be attributed to the model unless their name is specifically mentioned.

RETOUCHING, CONVERSIONS, AND DIGITAL FILES: Standard retouching includes light blemish and stray hair removal. Tonal conversions include converting color images to black-and-white. Files are automatically lightly retouched and available in color and black and white for no added fee.

Images received from Forbidden Fruit Photography may not be altered from their original version in any way. This includes but is not limited to: turning color images to black and white, cropping, or color accenting. Adding text/logo for advertising purposes is permitted. Photographs are hand-edited to Photographer's standards and reflect on the artist. Unedited images will not be given to the Model or third party under any circumstance.

ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived.

MODEL RELEASE: I hereby grant Forbidden Fruit Photography full permission to use Client-selected photographs for the purpose of display, portfolio, advertising, website, or publication to promote Forbidden Fruit Photography. I also consent that images may be used without additional compensation to the undersigned. I am of full age and have the right to contract in my own name. I have read this model release and fully understand the contents thereof. I have the legal authority to grant these permissions and I accept all responsibility for such. I am at least 18 years of age.
